TERMS AND CONDITIONS

GENERAL

These general terms and conditions (the ”General Conditions”) apply when you as a consumer (the ”Customer”) place an order via www.koyia.se, (the ”Website”). The agreement is concluded between you and Koyia. If you are under 18 years of age, you have to have permission from your guardian to order from us.

By using the Services, you acknowledge and accept that the General Terms will be updated from time to time. You should, therefore, keep up to date with this page, to be aware of potential changes to the General Terms made by Koyia.

Access to the website is given on a temporary basis and Koyia reserves the right to revoke or change the services without any prior notice. Koyia will not be held responsible if this website is unavailable at any point for a certain period of time. From time to time we might restrict access to certain parts or the entire website.

PRICING

All prices include 25% VAT. Koyia reserves the right to change pricing on a continual basis for all products in our range, regardless of whether it involves an increase or decrease. The price stated at the time of purchase applies. Every Koyia campaign applies while supplies last unless otherwise stated in the product description.

TAXES & DUTIES

Your order may be subject to local taxes and import duties, which are levied by your local customs authority or the used shipping carrier. We are unable to calculate the exact amount in duties and taxes your order might incur, as these charges are imposed directly by the destination country and vary between countries. Koyia does not cover any such taxes, duties or related charges.

ORDERING

Once we have received your order you will receive an automatic email confirming your order. Please note that the confirmation e-mail is only an acknowledgement that we have received your order and not an acceptance of your order. Once the order has been processed you will receive a shipping confirmation email. Koyia does not guarantee that all items included on the site are in stock at the time of your order. In the event that an item is unavailable you will be contacted shortly by email. 

All orders submitted by you are subject to acceptance by us. We may choose not to accept your order and reserve the right not to deliver for any reason without any liability to you. Examples of when we may not accept your order include, but are not limited to, incorrect stock level shown on site at the time of receiving the order or if we are unable to authorize your payment.

We reserve the right to limit the quantities of Koyia products that we supply, and/or to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a client with whom there is a dispute concerning the payment of a previous order. All attempts at fraud will be reported to the police and Koyia reserves the right to cancel the purchase if any suspicion is raised.

ORDER CONFIRMATION AND TRANSFER OF RISK

When we have received your order, an order confirmation will be sent by email. You become the owner of the ordered goods when they have been physically delivered to you and we have received payment in full from you. When the goods have been delivered to you, the responsibility for any loss or damage is passed on to you. 

PRODUCTS

We do our utmost to show the colors and design of our products as true to life and as accurately as possible on our website, but we cannot guarantee that the colors displayed in the online shop are exactly what they are like in real life. The color on the screen could depend on your computer and the settings of your screen. Not can we guarantee that all the images replicate exactly what the goods look like in real life.

Koyia has the right to change product information such as product pictures and offers without notice. 

PROMOTIONS

Promotion codes are limited to one time per customer and cannot be combined with other offers, if not otherwise explicitly stated. Promotion codes and offers are only valid within the explicitly set time or as far as we have stock and not applicable to previously placed orders.

COOKIES

Cookies are used in the site, in order to improve your experience of the site. As you navigate our site, your preferences are remembered through the temporary use of “session” cookies. Cookies enable our systems to gather information about your browser as well as monitor the navigational patterns you take while browsing the site. Koyia cannot guarantee that the content on the page is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date and we may at any time amend the content of the site www.koyia.se may contain links to other sites that we do not control. We are not responsible for the privacy or content of these websites or other accounts they may be linked to.

We respect the privacy rights of our visitors and recognize the importance of protecting your personal information. We have adopted a new Privacy Policy to comply with the new EU-regulations, GDPR. PRIVACY POLICY

Koyia collects your personal information only to fulfill our contract of sale. When ordering a product on the site you will be asked to fill in your personal information. Upon purchase you agree to this information being stored in accordance with Koyia’s  privacy policy in order to fulfill our agreement to you as a customer. All personal information saved at the site will be handled with the utmost care. Koyia treats all personal information confidential and it will not be sold or used for any other purposes than to process and fulfill your order and ensure the best service possible. Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. You have the right to request access to your data and if there is anything wrong you may have it changed or removed. If this is the case, send us an e-mail clearly stating your name, e-mail address and a short description of the matter.

LIABILITY

Koyia’s  responsibility for errors in connection to delivery is limited to existing conditions of sale. We bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.

Part of the services mediated through the site are maintained by outside organizations. Where Koyia acts as an agent for such services, we cannot be held responsible for any errors resulting from their activities. Koyia cannot be held responsible for any damage caused from using, or not being able to use, the site. Neither can we guarantee a problem-free, uninterrupted, and secure access to the site. The site may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.

FORCE MAJEUR

We have the right to assert force majeure in the event of war, warlike event, civil war, revolution, government sanction, strike, lockout, blockade, natural disaster or the like. This means that the agreement will not need to be fulfilled in part or in full. Should this, contrary to expectation, occur, we would attempt to notify you. Under such circumstances, Koyia will attempt to resolve all issues in a timely manner.

GOVERNING LAW

These Terms and Conditions are compiled in accordance with Swedish law. To the extent permitted by law, Swedish courts will have exclusive jurisdiction over any dispute under this agreement. The laws of your country may differ from Sweden and there may be additional legal requirements to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our site.
